For the purpose of this guide, peril is considered to exist when there is a threat to the ship, cargo or personnel, or when there is a risk of causing substantial pollution. In such a situation, the master should immediately take all appropriate action for the safety of life and to prevent or minimise damage to the ship, her cargo and the environment.
The guide emphasises the importance of early notification of the situation to all who may be concerned, including coastal states, salvors, other ships in the area and, of course, the operator of the ship. Examples of messages are given and may be used to assist when drafting actual reports in a perilous situation.
The guide takes account of Lloyd’s Standard Form of Salvage Agreement (Lloyd’s Open Form - LOF) and a copy of the current version (LOF 1995) and LOF 1980 are appended to the text. LOF 1995 is governed by English Law which incorporates the 1989 International Convention on Salvage and its use is to be encouraged. It should be borne in mind that there are ongoing discussions on the revision of LOF 1995. Ship owners, ship operators and ship masters should be aware that a revised version of Lloyd’s Open Form may be adopted in the near future.
The guide incorporates the amendments made to the International Convention for Safety of Life at Sea 1974 (SOLAS) which are now contained in Chapter II-l, Part A-I, Regulation 3-4 covering emergency towing arrangements for tankers and IMO Resolution MSC. 35(63) which provides guidelines on the subject.
